The family of 9-year-old King Overton is set to file a wrongful death lawsuit against SwimRVA after the boy drowned on his first day at the summer camp in Henrico County, NBC12 reported.

Civil rights attorney Ben Crump has joined the family's legal team and will be present in Richmond for the filing at the John Marshall Courts Building, WTVR reported.

King's mother had enrolled him in the SwimRVA camp to learn how to swim and informed staff that he could not swim, according to NBC12. The drowning occurred on June 15, and preliminary reports indicate a bystander, not a lifeguard, pulled King from the water while another bystander performed CPR.

The family has raised questions about how long King was underwater before being noticed. The Virginia Department of Education determined that SwimRVA was not exempt from state licensing requirements for its summer camp program, NBC12 reported.

WTVR noted that a special prosecutor took over the case in August after a conflict of interest was found in the Henrico Commonwealth's Attorney's Office. Investigations and questions about the circumstances of King's death continue.

The family’s attorney stated they will pursue all legal options to hold SwimRVA accountable for the incident.
