The Department of Justice filed a lawsuit against Pennsylvania State University for providing in-state tuition rates to some students in the country illegally, according to The Hill.

The DOJ argues that this policy discriminates against U.S. citizens, citing a congressional policy that states and public institutions may not grant tuition benefits to undocumented immigrants unless the same benefits are extended to citizens, The Hill reported.

This lawsuit is part of a broader effort by the Trump administration to challenge similar tuition policies. The Daily Gazette noted that two dozen states previously offered such tuition breaks, often with bipartisan support, but many have ended these policies following legal challenges.

The Daily Gazette also reported that the administration has recently targeted individual schools, with a similar lawsuit filed against the University of Delaware last month.

The outcome of these legal challenges could affect how public universities across the country set tuition policies for undocumented students.
