Lawyers argue double jeopardy should dismiss state murder trial for Mangione
Defense lawyers claim Mangione's federal guilty plea bars separate state murder and weapons case trial.
Lawyers for Luigi Mangione continued to seek dismissal of his state court murder and weapons charges, arguing that his recent guilty plea to federal stalking charges prevents a separate trial, NBC News reported.
Mangione pleaded guilty in August in Manhattan federal court to stalking charges related to the death of UnitedHealthcare CEO Brian Thompson, according to NBC News. This plea has prompted legal debate over whether the state prosecution for second-degree murder and weapons possession can proceed.
The state trial was postponed indefinitely to address the double jeopardy question, with a ruling on the dismissal expected by December 10, NBC News said.
The Manhattan District Attorney's office argues the state charges are distinct from the federal stalking offenses, emphasizing that murder is not typically covered by federal law, thus allowing the state case to move forward.
Mangione's defense team contends the charges in both cases are materially the same, asserting that the federal offenses leading to his guilty plea effectively cover the same conduct as the state murder and weapons charges, NBC News reported.
