Judge rules Maurene Comey was unlawfully fired by Trump Justice Department
A federal judge found that Maurene Comey was illegally dismissed as a prosecutor in 2025, rejecting claims of presidential removal power.
A federal judge ruled that Maurene Comey, daughter of former FBI Director James Comey, was unlawfully fired from her role as an assistant U.S. attorney in New York in July 2025, WTOP reported.
Judge Jesse M. Furman noted that Comey had worked on high-profile cases and consistently earned top evaluations from supervisors and peers. After her dismissal, Comey sued the Justice Department, alleging her firing violated constitutional protections including separation of powers, the First Amendment, and due process under the Fifth Amendment.
Comey claimed she was terminated due to her family connection to James Comey, who was a known opponent of then-President Donald Trump, or because of her perceived political beliefs, according to the judge's findings.
The government argued that the president has conclusive authority to remove federal prosecutors, but Judge Furman rejected this, stating the claim contradicts nearly two centuries of Supreme Court precedent. He emphasized that accepting the government's position would disrupt the constitutional balance of power.
The Justice Department has not yet commented on the ruling. This decision highlights ongoing legal debates over the limits of presidential power in federal prosecutions.
