Retrial starts Monday for man accused of killing Sierra LaMar in 2012
A retrial begins for a man convicted in 2017 of killing Sierra LaMar, whose conviction was overturned earlier this year.
Santa Clara County prosecutors will return to court Monday for the retrial of a man accused of killing 15-year-old Sierra LaMar in 2012, CBS News Bay Area reported. LaMar, a Morgan Hill teenager, disappeared on her way to Sobrante High School and was never found, according to the Santa Clara County Sheriff's Office.
The man was convicted in 2017 of LaMar's murder and three attempted kidnappings from 2009 in Morgan Hill. However, his conviction was overturned in February 2026 by the California 6th Appellate District Court due to issues with how the charges were consolidated during the trial.
The appellate court ruled that combining the 2012 murder charge with the 2009 attempted kidnapping charges was improper because the crimes were not sufficiently similar to establish a common motive. The court found that this consolidation led to the improper cross-admission of evidence, which prejudiced the defendant.
The defendant's legal team had requested separate trials for the murder and kidnapping charges, but the prosecution opposed this and the trial court denied the request. The retrial will proceed with these considerations in mind.
