An appeals court has declined to rule on whether California elections officials can count about 20,000 ballots that the U.S. Department of Justice alleges likely belong to noncitizen voters, LAist reported.

The court's 2-1 decision means the ballots will not be blocked from being counted at this stage, but the issue is not resolved yet.

The decision sets up another legal proceeding scheduled for the next day in front of a federal district judge.

The federal government has a very short window to try to compel California to exclude these ballots from the count, according to LAist.
